Sutter Creek Planning Commission: Powder House Estates Developer Asks For 2 Year Map Extension |

An extension of the Powder
House Estates tentative map appeared before the Sutter Creek Planning
Commission Monday night. The developer Stan Gamble, the same developer who is
developing Golden Hills, asked for a 24 month extension on the tentative map. The project previously known as the Oak Knolls was approved as
Oak Knolls in 1993 for 94 single family residential lots and 17.3 acres of open
space. The map was due to expire in November of 2005, but a new project
was submitted under the name of the Powder House Estates and in April of 2003 the Planning Commission
determined that the EIR originally prepared for Oak Knolls was no longer adequate
based on CEQA guidelines. The EIR was updated and subsequently appealed.
In April of 2004 the Vesting Tentative Subdivision map for the project was
approved.
The project includes 53 single-family residential
lots, 54 townhouses, and 16.8 acres of open space that is to be dedicated to
the City. The EIR however identified significant and
unavoidable impacts related to cumulative traffic impacts on the Main
Street-Gopher Flat Rd-and Haden Alley intersection. Thus the Planning
Commission adopted a statement of Overriding Concern. Since that time the
developer has asked for the Map extension. The matter was previously continued
from April 9th as it was not properly agenized for that meeting. At
that time Commissioner
Robin Peters expressed concerns over the number of months that the applicant
has requested, especially if the deemed time should be allotted to a twelve
month or 24 month extension.
Staff reviewed Section 17.20.010 of the Municipal Code and found that it
applies to projects that have filed a final map for review and are seeking an
extension of the map in order to complete the requirements for the final map
and have it recorded. According to Senior Planner Darcy Goulart it appears that the Title
17 is silent on tentative or vesting map extensions and would therefore default
to the timelines specified in the Subdivision Map Act which allows a
subdivision map to be extended for 24 months. The motion was granted to
allow the timeline extension for a 2 year period. The Gold Country Plaza off premise sign permit
was postponed with no action to be taken in the foreseeable future.
